RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY, AND COVENANT NOT TO SUE

By registering for, attending, entering, observing, or participating in this event in San Francisco, California (the “Event”), I acknowledge and agree as follows:

I understand that this Event involves live drone operations and related activities, including but not limited to drone flight demonstrations, takeoffs, landings, rotating propellers, batteries, charging equipment, audiovisual equipment, exhibitors, crowd movement, walking surfaces, and other event-related activities and conditions (collectively, the “Activities”). I understand that the Activities involve inherent and other risks, both known and unknown, obvious and non-obvious, that may result in bodily injury, illness, emotional distress, property damage, serious injury, permanent disability, or death.

I knowingly, voluntarily, and expressly assume all risks arising out of or relating in any way to my registration for, presence at, attendance at, observation of, movement through, or participation in the Event or the Activities, including risks arising from live drone operations, equipment malfunction, pilot error, signal loss, loss of control, hard landings, battery fire, flying or falling objects, barriers, crowd conditions, weather, premises conditions, and the acts or omissions of other attendees or third parties.

In consideration for being permitted to attend or participate in the Event, I, on behalf of myself and anyone who could assert a claim through me, hereby release, waive, discharge, and covenant not to sue Remote Optix Inc., Drones of San Francisco, SF Drone School, Thurber Shots, Din Drones, the venue, venue owner, property owner, property manager, all event hosts, sponsors, co-sponsors, exhibitors, vendors, drone operators, remote pilots, visual observers, speakers, staff, contractors, subcontractors, volunteers, affiliates, parents, subsidiaries, officers, directors, managers, members, agents, representatives, successors, assigns, and insurers (collectively, the “Released Parties”) from and for any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses of any kind, including attorneys’ fees, arising out of or relating in any way to my attendance at or participation in the Event or the Activities, including claims for personal injury, wrongful death, property damage, premises liability, and the ordinary negligence of any Released Party, to the fullest extent permitted by California law.

I understand and agree that this release does not apply to claims that cannot be waived under applicable law.

I agree not to enter any restricted, barricaded, controlled, crew-only, takeoff, landing, staging, or active flight area unless expressly authorized by event personnel. I agree to follow all posted rules, verbal instructions, safety announcements, signage, barriers, and directions from event staff, safety personnel, and drone operation personnel at all times. I understand that the Event may require me to remain outside designated drone safety perimeters and that failure to comply may result in immediate removal without refund.

I further agree to indemnify, defend, and hold harmless the Released Parties from and against any third-party claim, demand, action, liability, damage, cost, or expense, including attorneys’ fees, arising out of or relating to my acts, omissions, misconduct, violation of Event rules, or entry into restricted areas.

I consent to emergency medical care if deemed appropriate by Event personnel or emergency responders, and I assume full responsibility for any resulting medical, transport, or related costs. I understand that none of the Released Parties has any duty to provide medical care, security, or rescue services.

I assume all risk of loss, theft, or damage to my personal property at or related to the Event.

I grant the Released Parties the right to photograph, record, livestream, or otherwise capture my name, voice, image, and likeness at the Event and to use that content in any media for lawful promotional, commercial, editorial, archival, and event-related purposes without compensation or further approval.

I understand that under California Civil Code section 1542, a general release does not extend to claims I do not know or suspect to exist in my favor at the time of executing the release, which, if known by me, would have materially affected my settlement with the released party. I expressly waive any rights I may have under California Civil Code section 1542, and I understand and intend that this release applies to all claims released here, whether known or unknown, suspected or unsuspected, to the fullest extent permitted by law.

This agreement is governed by California law. If any provision is held unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law. This agreement is intended to be as broad and inclusive as permitted by California law.
